Imagine your mate is making a documentary. In this documentary, he uses one of your videos. His video blows up and he then proceeds to monetize it. So he has taken your content and used it in his video, monetized it, no permission. What action do you take?
Goose, I don't have a problem with this Depot lore video nor will I take any action. But remember - being courteous is always healthy.
-
Falls under fair use maybe?
-
Because it was uploaded and is property of the-elite.net, it would no longer be Ace's property....technically. :v
-
technically Ace doesn't even have the rights to post the video in the first place, as it is not his game. You can't claim to have rights on something you don't have any rights on to begin with :nesquik:

"Yep, it's our property forever when it's posted to the rankings. But we just say it's our property and never back it up and if you delete the video it's your fault, totally not our problem! gg Marc's 0:23. :nesquik:" If something is your property, keep it with you and take care of it.
But regardless, why should my run(s) be fully owned by the Elite? That's something I disagree with.

Its like SoFlo Antonio. He was just taking other peoples "kissing pranks" and uploading them on his YT channel.. and making bank i heard. People called him out for it but it would be under fair use i believe.

just like your capture cards/consoles eh mate? :kappa:

Disagree all you want, but when you signed up you agreed to it. :nesquik:
And yes, if you want to send me the raw files of your run instead of just a youtube link, feel free! Otherwise, it's YOUR responsibility to keep the videos available, and if we find them not to be available because of purposeful removal, it is indeed gg tbh.

(Un)fortunately, Alec is correct. "* As of February 1st, 2005 and following, all times submitted to the Elite will be considered the joint property of the-elite.net and the individual responsible for said times." ..https://forums.the-elite.net/index.php?topic=546.msg196896#msg196896 I was only 10 years old when I registered and too naive to fully understand the meaning of these rules. But now that I am aware of the problems this can cause, I will no longer post my times to the rankings unless a compromise is made. Because frankly, I have been treated like shit the past half year.

I think there is a problem if you claim it is YOUR property but rely on someone else for the video to exist. That's more like irresponsibility. Don't enforce a rule if you can't follow it and understand what it entails?

So glad this thread is in the Gentlemen's Club. :nesquik:

Yeah I've actually thought a fair bit about this, and this is the response I would give.
Ace - is it ok for me to use any and all of your videos in my lore series this year? Could you provide a list of videos you want specifically excluded from being shown? I am just trying to be courteous.
-
I personally do not like my videos being used by others for monetization purposes. But going by the rules, which is always my foremost priority, my videos are technically property of the Elite as well and given how well-received these lore videos are, they probably are alright with it so I don't think you should be having a problem.

Ace

Thank you Ace.
Also, just for your peace of mind, here are the metrics for my last 28 days on Youtube in terms of monetization;
I don't know how exactly you want to cut it, but your clip is 25 seconds of a 1h18m video, or 25 out of 4680, which is 0.5% of the video. Also, the majority of the content even about your run is my knowledge, interpretation and wisdom. So even of that 0.5%, most of it is still my own content talking about your run (think about a music documentary where someone talks about seeing a band at Woodstock, for example; that content is owned by that person, not the band they're talking about.)
There is this impression that I'm making tens of thousands of dollars on Twitch and Youtube, which isn't true at all. But if you want your 0.25% of $25.10, which is roughly $0.07 USD, I can gladly send it your way as a royalty once this royalty has reached a reasonable amount of money (say like, $10.00 over the course of the year, if it ever gets to that point.)

loooool caring about someone else using your video game play recording in an entertainment video :rollin:
-
Goose,
I appreciate the detailed response. I am, however, not interested in any royalties.

Ace

Can I accept his royalties on his behalf?
